Terms and Conditions

Overview

The Pedal to the Metal with Hunter and FX Luminaire promotion (“Raffle”) sponsored by Hunter Industries (“Sponsor”) is designed to help Ewing Irrigation & Landscape Supply employees gain product and industry knowledge. The Program is hosted and can be viewed online at hunterindustries.com/revitup/ewing (“Site”). Each individual who is eligible for and participating in the Program (“Member”) is entitled to earn coins (“Coins”) to take advantage of Program raffle prizes (“Rewards”). By participating in the Raffle, participants agree to be bound by these official rules and entrants acknowledge, understand, and agree that their participation in the Raffle is voluntary.

Program Terms

The following Terms and Conditions (“Terms”) contain important information regarding the Program. Entrants should read the Terms carefully. These Terms are a binding agreement between the Sponsor and each Member and will govern participation in any and all Program offerings. Participation in the Program constitutes the Member’s agreement to the Site Terms, and the Site privacy policy, which are incorporated herein. The Sponsor may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the Program and/or any Rewards at any time, including the availability Rewards, with or without notice.

Program Period

The Program is valid from March 17 to November 30, 2020. The Sponsor reserves the right to terminate, suspend, modify, or convert the Program at any time.

Eligibility Requirements

The Raffle is valid only in Alabama, Florida (Panhandle region only), Georgia, Louisiana, Maryland (excluding the Eastern Shore region), Mississippi, North Carolina, South Carolina, Tennessee, Virginia, or West Virginia. Each Member must be at least 18 years of age, a citizen or permanent resident of the United States, a resident of one of the regions listed above, and an employee of Ewing Irrigation & Landscape Supply and/or its affiliate companies to be eligible to participate. Hunter employees and immediate family members are ineligible to participate. Employees of direct competitors or other manufacturers of irrigation and/or outdoor lighting products are ineligible to participate. To participate, each Member must have or register for a Hunter account at hunterindustries.com/revitup.

Program Rewards

After creating a Hunter account, each Member can begin earning Coins to redeem for raffle entries.

Earning Coins

Coins can be earned in the following ways:

  • Weekly questions: Each Member can answer weekly Hunter and FX Luminaire trivia questions correctly to earn coins:
    • 50 coins per question on the first attempt
    • 25 coins per question on subsequent attempts
  • Bonus Pit Stops: Throughout the program, there will be additional opportunities to earn coins. These bonus Pit Stops can be, but are not limited to, questions, tasks, trainings, or participation in events. Members may have different opportunities to earn Coins depending on their region.
  • Additional coin opportunities can be presented throughout the promotion.

The Sponsor reserves the right to adjudicate all discrepancies regarding Coins in its sole discretion, and each Member agrees to abide by any such adjudication. The Sponsor reserves the right to suspend, terminate, revalue, or modify, without liability or notice to Members, all or part of the Coins value structure.

Coins: Maximum

Participants are not eligible to earn more than 20,000 coins, unless otherwise approved by the Sponsor.

Coins: Expiration

Coins will expire at 11:59:59 p.m. PST on December 31, 2020.

Coins: Forfeiture

If a Member cancels their Account, that Member forfeits all Coins. Coins have no cash value and are not redeemable for cash at any time.

Rewards Redemptions

The Sponsor reserves the right to modify Rewards in its sole discretion, and each Member agrees to abide by any such adjudication. The Sponsor reserves the right to suspend, terminate, revalue, or modify, without liability or notice to Members, all or part of the Rewards value structure.

Raffle Prize Drawings

Refer to the Raffle Date Chart below for Pedal to the Medal raffle announcements. One Ewing employee from the Southeast region will win. All raffle entries must be submitted by 11:59:59 PST/PDT on the last day of the designated entry period to qualify for raffle participation. Members can redeem their Coins for multiple raffle entries to increase chances of winning. When a raffle winner is drawn, the entries will be cleared. All prizes will be awarded to the individual whose email address is listed on the winning entry. Raffle winners will be notified via the email address provided in their Hunter account.

Raffle winners must claim their prize within 30 calendar days. If a raffle winner fails to claim a prize or fails to inform Hunter Industries of their inability to claim the prize before the deadline, or is otherwise determined to have failed to comply with the raffle rules, then their entry will be forfeited, and Hunter Industries reserves the right to award the raffle prize to another entrant, at its sole discretion. Hunter Industries reserves the right to delay the announcement of any raffle winner, at its sole discretion.

Conditions of Acceptance

Before being awarded any raffle Rewards, winners must:

  1. Provide any and all complete and truthful information necessary to prove eligibility;
  2. Show valid government-issued, photographic identification;
  3. Acknowledge and agree that the winner releases the Sponsor, and all of their directors, managers, officers, employees, and agents — as well as their respective advertising and promotional agencies (collectively, the “Releasees”) — from any and all liability arising in connection with participation in the raffle and acceptance of any prize, including, without limitation, any financial, legal, or moral responsibility or loss or personal injury, including death, or damage to or loss of property suffered or incurred or arising from participating in the raffle or accepting the prize, whether suffered by the prize winner, or by their heirs, administrators, personal representatives, or executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission, negligence, or gross negligence of any or all of the Releasees. In the event a raffle winner is unable to provide any of the foregoing for any reason, then the Sponsor may, at its sole and absolute discretion, disqualify the raffle winner and award the prize to an alternate entrant. Winners may not assign or transfer any prizes.
Refunds and Returns

Rewards received as a result of Coins redemption may not be returned or exchanged for a refund of the applicable Coins redeemed for any such item (including cash or credit). All Rewards will ship to the address designated by each winning Member during the normal course of business.

Tax Conditions

Each Member is solely responsible for reporting such items on their tax returns and paying any associated federal, state, provincial, territorial, or local tax liabilities. Members may not assign or transfer any Rewards. The Sponsor makes no warranty in any respect as to any Rewards, merchandise, or service available within the Program.

Termination

The Sponsor may, in its sole and absolute discretion, cancel, change, suspend, or modify any aspect of the Program and/or any Reward at any time, including the availability of any Reward, without notice. The Sponsor may, in its sole and absolute discretion, terminate or suspend any Member’s participation in the Program for breach of these Terms, or for taking any actions that are inconsistent with the intent of these Terms. The Sponsor reserves the right at its sole discretion to prohibit any Member from participating in any aspect of the Program if the Sponsor deems or suspects that such Member has engaged in or has attempted to engage in any of the following: (a) acting in violation of these Terms; or (b) damaging, tampering with, or corrupting the operation of the Program or Site; or (c) acting with intent to annoy, harass, or abuse any other person; or (d) any inappropriate, uncooperative, disruptive, fraudulent, potentially fraudulent, or unusual behavior or activity; or (e) activity deemed in the sole discretion of the Sponsor to be generally inconsistent with the intended operation of the Program. Any decision the Sponsor makes relating to termination or suspension of any Member’s participation in the Program shall be final and binding in all respects. The Sponsor shall be the sole determiner in cases of suspected abuse, fraud, or breach of these Terms.

Release

By participating in the Program, Members release the Sponsor, its parent company, subsidiaries, affiliates, suppliers, advertising and promotions agencies and their respective directors, officers, employees, and agents from any and all liability for any loss, harm, damages, cost, or expense, including, without limitation, property damages, personal injury, and/or death, arising out of or in any way connected to the Program and/or the use of any Rewards.

Consent to the Collection and Use of Personal Information

Except where prohibited by law, names and/or likenesses and quotes of Members may be disclosed to and otherwise used by the Sponsor for publicity purposes and in lists of prize winners to be published in emails, social media, printed materials, and on the web. By participating in the Program, each Member agrees to voluntarily provide personal information including, but not limited to, name, address, city, email address, photos, and home and office telephone numbers. Each Member grants permission to the Sponsor for the collection and use of their information.

Indemnification

Each Member agrees to indemnify, defend, and hold the Sponsor and its representatives and agents harmless from and against any and all third-party claims, demands, liabilities, costs, or expenses, including attorney’s fees and costs, arising from, or related to any breach by Member of any of these Terms or any violation by Member of any applicable laws.

Compliance with Laws

This Program is void where prohibited by law and is subject to all applicable federal, state, and local laws and regulations. All federal, state, and/or local tax consequences and liabilities for any and all Rewards are the sole responsibility of the Members.
